Starting on July 1st, 2014, Canadian Anti-Spam Legislation (CASL) requires businesses to provide an avenue for Canadian citizens to opt out of receiving commercial electronic messages (CEMs), including Emails and certain types of social media messages. All electronic marketing messages will need to clearly and prominently identify the sender, include the sender’s contact information, and provide an unsubscribe mechanism, unless fully exempted from the Act.

CCM is in compliance and has the required functionality in place to support the new laws.
In order to comply with Canada's anti-spam legislation, you must do the following when sending a commercial electronic message (CEM):
  1. Consent: Express or implied consent is required when sending messages. Implied consent is granted for the first 3 years after the law takes effect.
  2. Identification: You must clearly and simply identify yourselves and anyone else on whose behalf the message is sent. CCM provides an Email marketing tool which allows an Agency to customize messaging sent to registrants and other people. CCM will automatically include a message that the email was sent from your organization in mass emails sent from the Thriva system.
  3. Unsubscribe Mechanism: In every message you send, you must provide a way for recipients to unsubscribe from receiving messages in the future. CCM will automatically add text to mass emails and scheduled mails with information detailing how to unsubscribe from correspondence originating from your organization.

As a business utilizing CCM’s email tools, it is important to understand your obligations and determine how to be in compliance; ACTIVE Network wants to ensure our products support you! ACTIVE does recommend you include clear messaging and instructions on how to unsubscribe in all commercial electronic messages generated from our system, and to review the legislation with your own counsel.

FAQ's

Q: Is there anything I need to set up in CCM to be compliant?
A: No. The functionality is already in the system, and your organization does not need to set anything up.

Q: Can we modify the functionality or change the messaging?
A: No. The functionality and messaging is hard-coded and is not modifiable.

Q: Once someone is unsubscribed, can we change their preferences?
A: No. Once someone has chosen to exclude their email by unsubscribing, it won’t be able to be added back to your organization’s mails.

Q: Can we run a report to determine who has chosen to unsubscribe?
A: CCM does not have a report to show registrant emails which have been unsubscribed.
